Template Terms and Policies

By purchasing a digital product from Vanilla and Oak, hereinafter referred to as "Seller," you, the Purchaser, hereby agree to the following terms and conditions:

1. Ownership and Usage Rights:
   - All design templates provided by the Seller are the exclusive property of Vanilla and Oak. You are expressly prohibited from reselling, redistributing, or claiming these designs as your own creations.
   - Designers are permitted to utilize these templates as a foundation for crafting designs for their clients. However, the Seller's site credit must remain intact, and the Designer may add the credit "Customized by [Designer's Name]." Distributing these templates to users who have not purchased them is strictly prohibited.

2. Website Credit:
   - Upon purchasing a template from Vanilla and Oak, you are obligated to prominently display appropriate credit in the footer of your website, complete with an active hyperlink to Vanilla and Oak's website.

3. Platform Compatibility:
   - These templates are exclusively compatible with the Showit platform and are not intended for use on other website platforms.
   - To create or edit your website using one of these templates, you must possess a paid Showit subscription and may need additional software or purchases. These additional expenses are not covered by the template's purchase price.
   - The hosting, backup, storage, and services for your website are provided by Showit, and the Seller bears no responsibility for these aspects. Please review Showit's terms of service for further information: https://showit.co/terms-of-service/.
   - The Seller cannot guarantee that the templates will function flawlessly with new updates within Showit or various web browsers.

4. Technical Support:
   - You will receive technical support for issues directly related to the template itself. The Seller is not responsible for assisting with general Showit questions or technical issues unrelated to the template. For non-template-related issues, please contact Showit support.

5. Content Usage and Licensing:
   - These templates are not legally affiliated with Showit. Any images, custom fonts, or graphics provided are for illustrative purposes only.
   - You must ensure that you possess the necessary licenses to use any of the provided content.
   - While the images in the templates are sourced from free online stock websites, the Seller cannot guarantee their ongoing availability.
   - The Seller assumes no responsibility for any issues related to usage of images, fonts, and illustrations, including licensing or copyright infringements.

6. License for Promotional Use:
   - By purchasing one of the Seller's designs, you grant the Seller a permanent and royalty-free license to use representations of your website for promotional purposes on the Seller's website and social media platforms.

7. Pricing and Payment:
   - All prices listed during the checkout process are denominated in USD.
   - The Seller reserves the right to modify template pricing on the Seller's website, with or without prior notice. No discounts or refunds will be provided to match previous pricing.
   - If templates go on sale after your purchase, you are not entitled to retroactive discounts or refunds.

8. Payment Plan Terms:
   - If you select the payment plan option at checkout, you are required to complete the plan as agreed upon. Failure to do so may result in legal action.
   - You hereby authorize the Seller to retain access to your financial and contact information, stored by the third-party financial processing company Stripe or PayPal, until your payment plan is successfully completed.
   - All outstanding payments will be automatically deducted from your account as specified in the invoice. You are responsible for ensuring that your chosen payment method remains valid and has sufficient funds to cover all remaining payments.
   - The Seller reserves the right to pursue legal remedies to recover any outstanding debts. After 30 days of late payment, the Seller may initiate collections proceedings, at which point you will be liable for the total outstanding amount plus any associated collection costs, including reasonable attorney's fees.

9. Final Sale:
   - Due to the digital nature of these products, no templates can be returned, refunded, or exchanged after purchase. All sales are considered final.
   - Prior to making your purchase, it is your responsibility to thoroughly review the demo websites, pages, and template contents to ensure you understand the scope of each template.

These terms and conditions constitute a legally binding agreement between you and Vanilla and Oak. By purchasing a digital product from Vanilla and Oak, you acknowledge that you have read, understood, and accepted these terms and conditions in their entirety. Failure to comply with these terms may result in legal action.
